These Terms & Conditions govern your use of the TaylrJay website (https://www.taylrjay.com/) and the services provided, including mural projects and canvas artworks. By using this website, you agree to these Terms & Conditions.

Definitions

  • “My”,“we”, “us” and “our” refers to TaylrJay and any individuals contracted to work on my behalf.

  • “You”, “User” or “client” refers to the person accessing or using the website and services.

Use of Website and Services

  • You must be at least eighteen (18) years old or have permission from a legal guardian to use our services.

  • You agree to not use the website for any unlawful purposes, and not to violate any applicable laws while using these services.

Payments and Refunds

  • Payments: Payments are processed securely through third-party providers, and are due within 14 days of date of issue (unless otherwise specified).

  • Refunds: We do not offer refunds for change of mind on murals, mural designs, services, project management or artworks that have commenced or have been completed. Refunds may be available if the services provided do not meet the consumer guarantees under Australian Consumer Law (ACL), such as in cases of faulty, misrepresented, or incomplete services. Refunds are not available in instances where the client has not fulfilled their responsibilities (ie. did not provide a structurally sound surface), where damage to the product is at the fault of the client, improper or lack of maintenance and care has been undertaken, or any other instances that are the client’s responsibility.

Changes to Scope

  • Changes to the scope of the project outside the original briefing including but not limited to design, materials, coverage, etc. will incur an additional cost and may cause a delay. Any delays will be discussed so that additional dates for installation can be arranged.

Mural Surface

  • It is the client’s responsibility to provide a structurally sound, clean and quality surface to paint. Any visual concerns TaylrJay can identify will be discussed with the client. If the surface has ongoing issues which cause damage to the mural, this is the client’s responsibility and is at the client’s discretion to rectify.

Ongoing Mural Management

  • Cleaning and care for the mural will be the client’s responsibility. The lifespan of the mural will vary depending on surface quality, weather exposure and ongoing care. 

Copyright and IP

  • All content, including murals, designs, artworks, digital content and other materials provided by us, are the intellectual property of TaylrJay. You may not replicate, distribute, or use the content without permission.

  • In the case of murals, copyright will remain with the artist TaylrJay, who will grant the client non-exclusive license to reproduce the final work for marketing and promotional purposes. The work will remain the property of the client upon completion. The client may remove the artwork at their discretion if desired.

Liability and Indemnification

  • TaylrJay is not liable for any direct or indirect damages arising from the use of this website or services. You agree to indemnify and hold TaylrJay harmless from any claims arising from your use of the website and services.

User-Uploaded Content

  • You retain ownership of any content you upload to this website, but by submitting it, you grant TaylrJay a worldwide, royalty-free license to use, display, and distribute the content for marketing and promotional purposes.

Forbidden Uses

In addition to other prohibitions as set forth in these Terms & Conditions, you are forbidden from using this website or its content for any of the following:

  • Submitting false information, distributing malicious code, or engaging in harmful activities like spamming or phishing.

  • Violating any applicable laws or regulations, including international, federal, state, or local laws.

  • Engaging in unlawful activities or soliciting others to do so.

  • Infringing on intellectual property rights or abusing, harassing, or discriminating against others.

  • Interfering with security features or misusing the website for immoral or malicious purposes.

TaylrJay reserves the right to terminate your access and pursue legal action if you violate any of these prohibitions.

Changes to Terms & Conditions

  • TaylrJay may modify these Terms & Conditions at any time. Your continued use of this website after changes are implemented constitutes acceptance of the updated Terms & Conditions.

Governing Law

  • These Terms & Conditions are governed by and construed in accordance with the laws of South Australia, Australia and any legal disputes shall be handled by the courts in South Australia.

Acceptance

Upon confirmation to proceed and/or quote approval, the client confirms that they have read and understood the Terms & Conditions.
